Please read these terms carefully before using our medical transportation services.

These Terms of Service ("Terms") govern your use of medical transportation services provided by Sunday Ambulette ("we," "us," or "our"). By booking or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

Acceptance of Terms

By accessing, booking, or using Sunday Ambulette's medical transportation services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy.

These Terms constitute a legally binding agreement between you (the "Client," "Patient," or "you") and Sunday Ambulette. If you are booking services on behalf of another individual, you represent that you have the authority to accept these Terms on their behalf.

Important Notice

We reserve the right to modify these Terms at any time. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

Service Description

Sunday Ambulette provides non-emergency medical transportation services, including but not limited to:

  • Transportation to and from medical appointments, dialysis treatments, and therapy sessions
  • Inter-facility transfers between hospitals, nursing homes, and rehabilitation centers
  • Wheelchair-accessible transportation with trained medical attendants
  • Scheduled and on-demand medical transport services
  • Specialized transport for patients requiring medical supervision during transit

Service Limitations

Our services are designed for non-emergency medical transportation only. We do not provide:

  • Emergency ambulance services (call 911 for emergencies)
  • Advanced life support or critical care transport
  • Transportation for individuals requiring immediate medical intervention
  • Services for patients with unstable medical conditions without proper medical clearance

Booking and Reservations

How to Book

Services can be booked through:

  • Healthcare Providers: Through authorized healthcare facility coordinators

Advance Booking

We recommend booking services at least 24-48 hours in advance to ensure availability. Same-day bookings are accepted based on vehicle and staff availability.

Required Information

When booking, you must provide:

  • Full name, date of birth, and contact information
  • Pickup and drop-off addresses with specific instructions
  • Appointment date, time, and duration (if known)
  • Medical conditions, mobility requirements, and special needs
  • Insurance information or payment method
  • Emergency contact details

Accuracy of Information

You are responsible for providing accurate and complete information. Failure to disclose relevant medical conditions or mobility requirements may result in service delays or additional charges.

Fees and Payment

Service Fees

Transportation fees are based on:

  • Distance traveled (mileage-based pricing)
  • Type of service required (wheelchair, stretcher, medical attendant)
  • Wait time at medical facilities
  • After-hours or holiday surcharges (if applicable)
  • Additional services such as oxygen, IV monitoring, or specialized equipment

Payment Methods

We accept the following payment methods:

  • Insurance billing (Medicare, Medicaid, and private insurance)
  • Credit and debit cards
  • Cash payments
  • Direct facility billing for authorized healthcare providers

Insurance Claims

If using insurance, you are responsible for:

  • Verifying coverage with your insurance provider before booking
  • Providing accurate insurance information and authorization forms
  • Paying any co-payments, deductibles, or non-covered amounts
  • Understanding that insurance claim denials may result in patient responsibility for full payment

Cancellation and No-Show Policy

Cancellation Policy

To avoid cancellation fees, you must notify us:

  • At least 2 hours before scheduled pickup for same-day appointments
  • At least 24 hours before scheduled pickup for advance bookings
  • Cancellations can be made by phone at (555) 123-4567

Cancellation Fees

  • Less than 2 hours notice: 50% of the service fee
  • No-show (failure to be ready at scheduled time): 100% of the service fee
  • Weather-related or emergency cancellations: No fee (subject to verification)

Our Right to Cancel

We reserve the right to cancel or reschedule services due to:

  • Severe weather conditions or unsafe driving conditions
  • Vehicle mechanical issues or equipment failures
  • Staff illness or unavailability
  • Inaccurate or incomplete booking information
  • Patient's medical condition requiring higher level of care than we can provide

Late Pickups

While we strive for punctuality, traffic, weather, and previous trip delays may affect pickup times. We will notify you of any significant delays. You will not be charged for delays caused by our scheduling.

Patient Responsibilities

As a patient or authorized representative, you agree to:

Medical Information

  • Provide accurate and complete medical information, including all conditions, medications, and allergies
  • Inform us of any changes in your medical condition before scheduled transport
  • Obtain necessary medical clearance for transport if required by your healthcare provider
  • Disclose any communicable diseases or infection control requirements

Behavior and Conduct

  • Be ready at the scheduled pickup time with all necessary belongings
  • Treat our staff, drivers, and vehicles with respect
  • Follow all safety instructions and vehicle policies
  • Refrain from aggressive, abusive, or threatening behavior
  • Not smoke, vape, or use illegal substances in our vehicles

Accompaniment

  • Family members or caregivers may accompany patients when space permits
  • Minors must be accompanied by a parent or legal guardian
  • Patients with cognitive impairments should have an authorized representative present
  • Service animals are permitted; pets require advance approval

Liability and Insurance

Our Liability Coverage

Sunday Ambulette maintains comprehensive liability insurance covering:

  • General liability for injury or property damage during transport
  • Professional liability for medical attendant services
  • Vehicle insurance meeting all state and federal requirements
  • Workers' compensation for all employees

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for delays caused by traffic, weather, or circumstances beyond our control
  • We are not responsible for missed appointments due to patient delays in being ready for pickup
  • We are not liable for personal belongings left in vehicles
  • Our liability is limited to direct damages caused by our negligence
  • We are not liable for consequential damages, including missed medical treatments (except as required by law)

Patient Property

While we take reasonable care of your belongings:

  • You are responsible for your personal property at all times
  • We are not responsible for lost, stolen, or damaged items
  • Valuables should not be left unattended in vehicles
  • Medical equipment provided by us remains our property

Privacy and Confidentiality

We are committed to protecting your privacy and complying with HIPAA regulations:

  • All medical information is kept strictly confidential
  • Information is shared only with authorized healthcare providers and as required by law
  • Staff members are trained in HIPAA compliance and patient confidentiality

Prohibited Uses

You may not use our services for:

  • Emergency medical situations requiring immediate intervention (call 911)
  • Transporting individuals under the influence of alcohol or drugs (unless medically supervised)
  • Illegal activities or purposes
  • Transporting weapons, illegal substances, or hazardous materials
  • Any purpose that violates local, state, or federal laws

Service Refusal

We reserve the right to refuse service to anyone who violates these Terms, poses a safety risk to staff or other patients, or engages in abusive or threatening behavior.

Dispute Resolution

Complaints and Concerns

If you have a complaint about our services:

  • We will investigate all complaints within 5 business days
  • You will receive a written response detailing our findings and any corrective actions

Arbitration Agreement

Any disputes arising from these Terms or our services shall be resolved through binding arbitration rather than in court, except where prohibited by law. This arbitration agreement includes:

  • All disputes will be resolved by a neutral arbitrator
  • Arbitration will be conducted under the rules of the American Arbitration Association
  • The arbitration will take place in New York, NY
  • Each party will bear their own costs and fees
  • The arbitrator's decision is final and binding

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. We will notify you of material changes through:

  • Email notification to the address on file
  • Notice on our website homepage
  • Notification during your next service appointment

Your continued use of our services after any changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in New York, NY.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
